These Terms & Conditions govern your use of Africa Health Plus. By accessing, registering, listing, or purchasing through our marketplace, you agree to comply with these terms.

🏢 1. Who We Are

Africa Health Plus is a multi-vendor healthcare marketplace connecting buyers and sellers across Africa.

• We facilitate transactions but are not the direct seller for most products.
• Vendors are responsible for their own listings, products, and services.
• Ownership: Africa Health Plus is owned and operated by Africa Health Limited (UK) in partnership with Wellnexus Ventures (India).

💼 2. Vendor Terms

A. Vendor Registration 📝

Vendors must:

• Provide accurate business and regulatory information.
• Obtain and maintain all licenses and certifications required for selling healthcare products or services.

B. Listings 📋

Vendors are responsible for:

• Product descriptions, images, and pricing accuracy.
• Compliance with all applicable health, safety, and regulatory standards.
• We reserve the right to remove listings that violate laws, infringe rights, or breach these Terms.

C. Order Fulfilment 🚚

Vendors must:

• Process and dispatch orders promptly.
• Ensure quality and authenticity of products supplied.

D. Vendor Fees 💳

Vendors agree to pay applicable platform commissions and fees as communicated upon registration and updated from time to time.

E. Vendor Subscription Plans 📦

• We may offer different subscription plans for vendors, each with specific features, limits, and pricing.
• Vendors must:
• Select and subscribe to an appropriate plan for their business needs.
• Pay subscription fees as per the plan terms.
• Understand that failure to pay on time may result in suspension or termination of their vendor account, product listings, and associated services.
• Acknowledge that plan features and pricing may change with prior notice where required by law.

🛒 3. Purchases & Payments

A. Order Acceptance ✅

We may refuse or cancel orders due to:

• Product unavailability.
• Errors in product or pricing information.
• Suspected fraud.

B. Payment Processing 💳

• Payments are processed securely via our payment gateway partners.
• We do not store full card details.
• You agree to provide valid payment information and authorize charges for orders placed.

📦 4. Shipping & Delivery

• Delivery timelines are estimates only.
• We are not liable for delays due to unforeseen circumstances.
• Risk of loss passes to the customer upon delivery to the shipping carrier.
• Customs duties and taxes may apply in different African countries — customers are responsible for these unless otherwise stated.

🔄 5. Returns, Refunds & Cancellations

• Governed by our Return & Refund Policy.
• Policies vary by vendor; always review vendor-specific terms before purchase.
• Some healthcare products are non-returnable due to hygiene, safety, or legal restrictions.

💬 6. User Content

• Users may post reviews, ratings, or comments.
• You agree your content will not be illegal, defamatory, infringing, obscene, or harmful.
• By posting, you grant Africa Health Plus a non-exclusive, royalty-free, perpetual license to use and display your content.
• We may remove content at our discretion.

🧠 7. Intellectual Property

• All content, trademarks, logos, and service marks are owned or licensed to us.
• You may not use, reproduce, or distribute them without written consent.

🔒 8. Privacy

• Personal data use is governed by our Privacy Policy.
• Vendors may also collect certain data to fulfill orders — check their policies.

• We are not responsible for their content, privacy practices, or transactions.

• Services are provided “as is” and “as available”.
• We do not guarantee uninterrupted, error-free, or secure service.
• Product information is provided by vendors; we do not guarantee accuracy or quality.

📏 11. Limitation of Liability

• To the fullest extent permitted by law:
• Africa Health Plus and affiliates are not liable for indirect, incidental, consequential, or punitive damages.
• Our total liability for any claim is limited to the amount you paid us in the last 3 months.

🛡️ 12. Indemnity

You agree to indemnify and hold harmless Africa Health Plus, Doctor 4 Africa, and their affiliates from claims, damages, or expenses arising from:

• Your use or misuse of the Services.
• Your breach of these Terms.
• Your infringement of third-party rights.

We may suspend or terminate your access at any time for any reason, including violations of these Terms.

• These Terms are governed by the laws of India
• Disputes will be resolved via arbitration or courts located in India, unless otherwise required by law.
